These Terms and Conditions (“Terms”) govern your access to and use of the website https://proyeku.co (the “Site”) and the services offered by Proyeku (“Proyeku”, “we”, “us”, or “our”), including the purchase of architectural designs, technical drawings, rendered images, furniture designs, the Partner Dashboard, and the Kontraktorku contractor referral service. By accessing or using the Site, you agree to be bound by these Terms.

1. Definitions

Customer: Any user who browses or purchases digital products from the Site.
Partner: A designer who has registered for and been approved to upload, list, and sell their own designs via the Partner Dashboard.
Product(s): Digital items available for purchase on the Site, including architectural designs, technical drawings, rendered images, and furniture designs.
Kontraktorku: The contractor referral service provided by Proyeku to facilitate real-world implementation of purchased designs.

2. Acceptance of Terms

By creating an account, making a purchase, or using any service on the Site, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy and Return & Refund Policy incorporated herein by reference.

3. Account Registration

Eligibility: You must be at least 18 years old and legally capable of entering into contracts.
Information Accuracy: You agree to provide accurate, current, and complete information during registration and to promptly update such information.
Account Security: You are responsible for safeguarding your password and account. You agree to notify Proyeku immediately of any unauthorized use.

4. Partner Dashboard

Application & Approval: Designers may apply to become Partners. We reserve the right to approve or reject any application at our sole discretion.
Upload & Review: Partners may upload their original design files. Proyeku will review submissions for compliance with content standards and technical requirements before listing.
Pricing & Fees: Partners set their own prices for each Product. Proyeku retains a certain service fee for each sale.
Licensing: Partners grant Proyeku a worldwide, non-exclusive license to display, distribute, and promote their Products on the Site. We may use marketing tools to help advertise their product on the platform or on social media.
Responsibility for Originality: Partners warrant that their submitted Products are original and do not infringe on third-party rights. Proyeku is not responsible for verifying originality and disclaims liability for any claims arising from plagiarism or copyright infringement.

5. Purchasing & Payment

Order Process: Customers select Products, complete checkout, and pay via the payment methods provided.
Payment Handling: All payments are processed by third-party payment processors. You agree to their terms and fees.
Taxes: You are responsible for any applicable taxes (e.g., VAT, sales tax).

6. License Grant & Restrictions

Customer License: Upon successful purchase, Proyeku grants you a limited, non-transferable, royalty-free license to download and use the digital files for personal or commercial use in accordance with the Product description.
Restrictions: You may not resell, redistribute, sublicense, or share the digital files in their original or modified form beyond your own use. You may not upload the files to other marketplaces, platforms, or file-sharing sites, whether for free or for sale. You are also not allowed to distribute the files offline, such as through USB drives, external hard disks, or any other physical means for your own benefit and other than to build with contractor.

7. Digital Delivery & Download

Instant & Permanent Access: Products are available for immediate download upon purchase. Download links remain permanently accessible in your account and do not expire.
Technical Support: If you encounter any issues accessing or downloading your files, contact support@proyeku.co.

8. Refund & Return Policy

All sales are final. Please refer to our Return & Refund Policy for details on non-refundable sales, defective files, and technical issues.

9. Contractor Referrals (Kontraktorku)

Optional Service: Proyeku may recommend contractors to implement purchased designs.
Data Sharing: By requesting a referral, you consent to share necessary project information with the contractor.
No Guarantee: Proyeku does not guarantee the quality, timeliness, or pricing of third-party contractor services.

10. User Content & Comments

Submissions: Users may submit comments or ratings on Products and Partner portfolios.
Moderation: Proyeku reserves the right to remove or refuse any content that violates our content standards.
Ownership: You retain ownership of your submissions but grant Proyeku a license to display and use them on the Site.

11. Intellectual Property

All content on the Site, excluding Partner Products and User Content, is owned by Proyeku or its licensors. Unauthorized use of Site content is strictly prohibited. If you believe that any content or Product on the Site infringes your intellectual property rights, please contact us with detailed information. We reserve the right to remove content or suspend accounts at our discretion while disputes are resolved.

12. Termination

Proyeku may suspend or terminate your account and access at any time for violations of these Terms or for any reason, without notice. Upon termination, licenses granted to you will terminate.

13. Disclaimers & Limitation of Liability

No Warranty: The Site and Products are provided “as is” without warranties of any kind.
Limitation: To the maximum extent permitted by law, Proyeku’s liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you for the relevant Product(s).

14. Changes to Terms

Proyeku reserves the right to modify these Terms at any time. We will notify you by posting revised Terms on the Site. Continued use after changes constitutes acceptance.
